Observed handwashing sink in main kitchen without hot water at time of inspection. A handwashing sink shall be equipped to provide tempered water at a temperature of at least 85ºF (29.4 ºC) through a mixing valve or combination faucet. Must correct within 10 calendar days.
8-2B - toxic substances properly identified, stored, used
Regulation: 511-6-1.07(6)(b) - working containers, common name (pf)
Observed an unknown liquid in a spray bottle not labeled with its common name. Working containers used for storing poisonous or toxic materials such as cleaners and sanitizers taken from bulk supplies shall be clearly and individually identified with the common name of the material. Must correct within 10 days.

Observed container of white substance not labeled with common name in main kitchen under prep table across from ice cream machine. Food Storage Containers, Identified with Common Name of Food. Except for containers holding food that can be readily and unmistakably recognized, such as dry pasta, working containers holding food or food ingredients that are removed from their original packages for use in the food establishment, such as cooking oils, flour, herbs, potato flakes, salt, spices, and sugar shall be clearly and legibly identified, in English, with the common name of the food. Must correct within 72 hours.

Observed several foods past expiration dates (milk in front reach in cooler as well as milk in back walk in cooler). Prepackaged sandwiches, eggs, infant formula, shucked oysters, milk, and time/temperature control safety foods that are labeled as “keep refrigerated” and that are for sale or service to the consumer or used as an ingredient in other foods shall be immediately discarded and shall not be sold, served, or used after the manufacturer’s expiration date or the sell-by date. Must correct within 72 hours.

Observed items in walk-in freezer that states must be kept frozen do not refreeze unthawed. Stored frozen foods shall be maintained frozen. Corrected on site by PIC.

Observed walk-in freezer not working properly. Observed items in freezer unthawed. Equipment for cooling and heating food, and holding cold and hot food, shall be sufficient in number and capacity to provide food temperatures as specified under DPH Rule 511-6-1-.04.

Observed most current inspection report not posted. Observed inspection report dated 01/03/2024 posted instead of the inspection dated 02/10/2025. Also observed inspection not posted within requirements of this chapter. Observed inspection report posted on wall where ice cream toppings bar is located and where it cannot be read from 1ft away. The most current inspection report shall be prominently displayed in public view at all times, within fifteen feet of the front or primary public door and between five feet and seven feet from the floor and in an area where it can be read at a distance of one foot away. Must correct within 72 hours.

Regulation: 511-6-1.05(3)(h),(i),(j) - temperature measuring device, manual warewashing; sanitizing solutions, testing device (pf)
Observed facility with incorrect testing strips for quat ammonia solutions. Observed facility with chlorine test strips. In manual warewashing operations, a temperature measuring device shall be provided and readily accessible for frequently measuring the washing and sanitizing temperatures. Must correct within 10 days.
