Observed that the facility does not have a certified food safety manager certificate posted and not able to verify that there is a CFSM for the unit during the inspection (certification unavailable). CA: Facility shall have a certified food safety manager in its employ that is designated to solely this facility.
2-2B - proper eating, tasting, drinking, or tobacco use
Regulation: 511-6-1.03(5)(k)1&2 - eating, drinking, or using tobacco (c)
Observed employee drink stored in non-single-use containers without a straw that were stored with and above food and food contact surfaces. CA: Employee drinks shall be stored in single-use containers with a lid and a straw and shall be handled to prevent contamination of food and food contact surfaces.
2-2D - adequate handwashing facilities supplied & accessible
Regulation: 511-6-1.06(2)(c) - handwashing sinks, installation (pf, c)
Observed that the hand sink did not have hot running water. COS. PIC set the water heater up and got water going. CA: Hand sinks shall be installed to provide hot and cold running water.

Observed that the hand sink as inaccessible due to items being stored in the basin. COS. Items moved. CA: Hand sinks shall be available at all times and only used for washing hands.
6-2 - proper date marking and disposition
Regulation: 511-6-1.04(6)(g) - ready-to-eat time/temperature control for safety food, date marking (pf)
Base violation: House made chimichurri (garlic in oil) is marked from 9/10 - 3/10. Discard. CA: unless have lab tested evidence of shelf life, keep TPHC foods for 7 days.
18 - insects, rodents, and animals not present
Regulation: 511-6-1.07(2)(n) - exterior walls and roofs, protective barrier (c)
Observed that there were assorted ~1 inch holes in various places in the floor and there was nothing covering/in the holes to prevent pest entry. CA: The exterior of the unit shall properly prevent pest entry.
10C - variance obtained for specialized processing methods

Base violation: * must provide ingredients and procedure in writing to resume selling chimichurri in jar.
16B - plumbing installed; proper backflow devices

Base violation:Observed garden hose for water supply. Must dedicate food grade hose for water supply to truck. Code: 1. Except as specified in paragraph 2 of this subsection, a water tank, pump, and hoses used for conveying drinking water shall be used for no other purpose

Observed employee belongings (phones, bags, jackets) stored with and above food and food contact surfaces throughout the unit. CA: Employee belongings and activities shall be in designated locations that prevent contamination of food and food contact surfaces.

Observed that the most recent inspection report was not posted. CA: The most recent inspection report shall be posted in the service window where it is readable from a distance of 1 foot away.
14C - single-use/single-service articles: properly stored, used
Regulation: 511-6-1.05(10)(e)1&3 - single-service/single-use items stored 6" off floor in clean, dry location (c)
Observed that single-use items were stored inverted on top of personal belongings so that the inside of the containers was touching the personal belongings. COS. Discarded. CA: Single-use items shall be stored in a manner that prevents contamination.
15A - food and nonfood-contact surfaces cleanable, properly designed, constructed, and used
Regulation: 511-6-1.05(1)(i) - nonfood-contact surfaces (c)
Observed that the facility is using unsealed wood as a counter. CA: Nonfood contact surfaces shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material.

Base violation:observed residential refrigerator. may use until breaks down or above 41F. Code: Food service equipment must be commercial grade equipment and designed and built according to standards set by American National standards Institute (ANSI) accredited certification programs.
