Employee was observed eating in the kitchen area rather than in the designated break area.

CA:1. Employees shall not use any form of tobacco products, or electronic devices that simulate tobacco smoking, while engaged in food preparation or service, nor while in areas used for equipment or utensil washing and storage, food preparation or food storage. Employees shall only use tobacco products or electronic devices that simulate tobacco smoking in approved designated areas.

2. Employees shall consume food only in approved designated areas separate from food preparation and serving areas, equipment or utensil areas and food storage areas. However, drinking from a single service beverage cup with a secure lid and straw that is handled to prevent contamination of the employee’s hands, the container, exposed food, clean equipment, utensils and linens, unwrapped single-service and single-use articles will be allowed.

Advised PIC that employees must consume food only in designated break areas

Multiple food items were observed in the prep-top cooler being stored without proper coverings.

CA: Except as specified under paragraph 2. of this subsection and when cooling as specified in DPH Rule 511-6-1-.04(6)(e)2.(ii), storing the food in packages, covered containers, or wrappings, except for loosely covered or uncovered containers in which food is being cooled if protected from overhead contamination;

Advised PIC that all food items must be properly covered during storage to protect against contamination

Permit not posted during time of inspection

CA:1. Post the permit in a location in the food service establishment that is conspicuous to consumers

Provided PIC a physical printed copy of permit and advised that it be displayed for the public view

Observed scoops stored in ice machine

CA: In a clean, protected location if the utensils, such as ice scoops, are used only with a food that is not time/temperature control for safety food;

Advised PIC that scoops should be stored in a clean, dry location outside of the ice bin

Observed shellstock tags, however, the dated tag with the last shellstock from the container sold or served was not observed.

Advised the PIC to always date record the tag of the last shellstock from the container is sold or served.

Observed shucked oysters removed from the original container and kept in a walk-in cooler until they are served and no labeling information was observed.

Molluscan shellfish may not be removed from the container in which they are received until immediately before sale or preparation for service and the labeling information for the shellfish is retained and correlated to the date when, or dates during which, the shellfish are sold or served.
